The troubled actress - who is currently on probation stemming from a driving under the influence conviction in 2007 - has been accused of taking a $2,500 necklace from upmarket Californian boutique Kamofie & Company and claimed she tried to bring it back to the store but did not have time.

According to a police report obtained by gossip website TMZ, Lindsay's assistant said: "Ms. Lohan was in possession of the necklace and wanted to give the necklace back to the store the day after she took it from the store, but she was very busy."

We intend to challenge the prosecution's case because the truth is, Ms. Lohan didn't steal anything.

Lindsay has pleaded guilty to felony grand theft over the incident, with friends insisting she was allowed to borrow the necklace, but the store later changed their mind after she failed to get them publicity.

While the 24-year-old star's team have been trying to agree a plea deal over the case - which counts as a breach of her probation - her lawyer Shawn Chapman Holley believes the charge is unfair as she disputes the estimated value of the piece of jewellery.

Shawn said: "We intend to challenge the prosecution's case because the truth is, Ms. Lohan didn't steal anything. But even if she had, it seems to me that the appropriate charge, based on the fair market value of the goods, should have been petty theft and not grand theft.

"A $5 lump of coal with a $2,500 price tag is still a $5 lump of coal."

Lindsay must return to court on February 23.

A prosecutor had advocated a six-month jail sentence for the "Mean Girls" star, but Fox opted for rehab after reviewing filings by probation and rehab officials and a letter written by Lohan. The actress cried after hearing the sentence.

The judge acknowledged that Lohan, 24, has been in-and-out of court and rehab since a pair of high-profile arrests in 2007.

He told the actress that he would not be manipulated by her, but was giving her a final chance to stay clean. "You're staying past the New Year's — there's a reason for that," Fox said.

Fox's sentence means Lohan will not be returning to a suburban Los Angeles women's jail for a fourth time. The judge had threatened to send Lohan to jail for 30 days for each drug test she skipped or failed.

He ordered her held for nearly a month during a hearing in September, but another judge overturned his ruling and Lohan has been free on bail and in inpatient rehab voluntarily since then.

Lohan is due back in court on February 25.

The judge had ordered Lohan to remain in jail until Friday, but his ruling was overturned. She remains free on bail and has been in rehab for several weeks.

It is Lohan's fifth court appearance since May in a three-year-old drunken driving case.

Los Angeles Superior Court Judge Elden S. Fox will formally determine whether the "Mean Girls" star violated her probation with the drug test in September. If the actress admits the results are accurate — as she has already done publicly — then Fox could return her to jail or order her to remain in an inpatient rehab program.

Fox had been expecting Lohan to arrive at court directly from jail, where he ordered her to be held on Sept. 24 after a brief hearing. Within hours another judge had overturned his ruling and the starlet was released on bail.

The following week, a person close to the actress told The Associated Press, Lohan entered rehab for the fifth time. The source spoke on condition of anonymity because of the sensitivity of the issue.

Her recent court troubles have put Lohan's career on hold. She missed opportunities to promote her role in the summer film "Machete" because she was in jail and rehab. Her next starring role is supposed to be in a biopic on porn actress Linda Lovelace.

Friday's hearing will be Lohan's fifth court appearance since May, when she ran into trouble with her probation on a three-year-old drug and drunken driving case.

In July and August, she spent 14 days in jail and 23 days in rehab as punishment for missing several court-ordered weekly counseling sessions.

Fox allowed her to be released from rehab early based on the recommendations of her doctors and laid out a path for her to be taken off probation by the end of the year. His regimen included frequent counseling sessions, meetings with probation officials and random drug screenings. It also included several incentives, including an assurance that if the actress complied with the terms for 67 days, her probation oversight would end and she would be free to move from Los Angeles. He also dismissed two drug charges that were filed after a pair of arrests in 2007.

Within weeks of her release from rehab, Lohan, 24, failed a drug test. She acknowledged the result in postings on Twitter and said she was struggling with addiction.

Fox had threatened to send her to 30 days in jail for each failed or missed test. He did not indicate at last month's hearing whether he was mulling other sentences.

Lohan's attorney, Shawn Chapman Holley, did not return e-mail and phone messages seeking comment.

If Lohan is sentenced to jail, she will be subject to early release due to jail overcrowding. When a judge sentenced her to three months in jail in July, she served 14 days. She spent 84 minutes at the jail in 2007 before being released due to overcrowding.

Lohan pleaded no contest to two counts of driving with a blood-alcohol level above 0.08 percent and one count of reckless driving. She was sentenced to three years of probation, but that was later extended after the actress didn't complete the terms of her sentence in time.

Lindsay, 24, has her own treatment team in the facility which is comprised of a personal physician, nurse, psychologist, primary counsellor, case manager, spiritual care counsellor, family counsellor, dietician, fitness trainer and chemical dependency technician.



After failing two drug tests last month, Lindsay is now due in court Oct 22 for a probation hearing.

"Bail has been set at 300,000 dollars, " Parachini added.


Habeas corpus refers to the release of an inmate due to unlawful detention. However, Judge Schnegg ruled that Lohan must be fitted with a SCRAM alcohol-monitoring device within 24 hours if she posts bail. She faces a probation violation hearing on Oct. 22.

Judge Fox's other option is to deny her bail, throw her in jail and set a hearing that would take place 30 days later. Under this scenario, Lindsay would not be released early she'd sit in jail for 30 days until her hearing. According to sources, judges do this 'all the time' when they want to make sure a defendant does the time.

Last week, Michael - who recently claimed the starlet has an addiction to prescription drugs - told gossip website X17 he wanted to "kidnap" his daughter and take her to an isolated location to help "get her straight".

He said: "I'm going to see the judge this week. If I can't get a conservatorship, then I'm going to take her to an undisclosed location and get her straight. But I know I'm going to get charged with kidnapping."

Lindsay has previously completed three stints in rehab in a bid to get help for her addiction to drink and drugs.

She was sentenced to one day in jail, community service and three years probation to include the alcohol awareness sessions.
